These Website Terms of Use constitute an agreement between you and GIJoeCodes, LLC (“SafetyShop,” “Company,” “we,” or “us”). By accessing or using the Website/iOS Application, you represent and warrant that you meet this eligibility requirement.

When doing so, you will be required to select a user ID and password. These Terms of Use permit you to utilize the Website/iOS Application strictly for personal, non-commercial purposes. If the Website/iOS Application offers social media sharing functionalities—such as integration with Facebook, Twitter, Instagram, or other platforms—you may engage with these features only as explicitly enabled.

All trademarks, service marks, logos, and trade names appearing on GIJoeCodes, LLC products, product packaging, and/or the Website/iOS Application—whether registered or not (including but not limited to the word mark “SafetyShop” and the SafetyShop logo)—shall remain the exclusive property of GIJoeCodes, LLC or its licensors, as applicable. These marks are protected under intellectual property and trademark laws.

You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify any of these marks in any manner—including in advertising, publicity, or the distribution of materials on the Website/iOS Application—without prior written consent from GIJoeCodes, LLC, which shall be granted at its sole discretion. Additionally, the use of any of these marks on another website or platform is strictly prohibited without express written authorization.

PROHIBITED USES

You may use the Website/iOS Application only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Website/iOS Application:

In violation of any applicable federal, state, local, or international law or regulation, including but not limited to export control laws governing data or software transfers.
To exploit, harm, or attempt to harm minors by exposing them to inappropriate content, soliciting personally identifiable information, or engaging in any form of exploitation.
To send, receive, upload, download, use, or re-use any material that does not comply with these Terms of Use.
To transmit or facilitate the sending of any unsolicited advertising or promotional materials, including but not limited to junk mail, chain letters, spam, or other solicitations.
To impersonate or attempt to impersonate GIJoeCodes, LLC, a GIJoeCodes, LLC employee, another user, or any other entity (including by using email addresses or screen names associated with such entities).
To engage in conduct that restricts or inhibits anyone’s use or enjoyment of the Website/iOS Application, or conduct that, in our judgment, may harm GIJoeCodes, LLC or its users, or expose them to liability.

Additionally, you agree not to:

Use the Website/iOS Application or any related software, device, or method in a manner that could disable, overburden, damage, or impair its proper functioning, or interfere with other users’ ability to engage in real-time activities.
Deploy any automated tools (including robots, spiders, or scrapers) to access the Website/iOS Application for any purpose, including data monitoring or copying content.
Introduce any malicious software, including viruses, Trojan horses, worms, logic bombs, or any other harmful or technologically disruptive elements.
Attempt unauthorized access to any portion of the Website/iOS Application, its servers, or any associated databases, systems, or networks.
Launch a denial-of-service (DoS) or distributed denial-of-service (DDoS) attack against the Website/iOS Application.
Otherwise attempt to interfere with the proper operation of the Website/iOS Application.

USER CONTRIBUTIONS

The Website may contain message boards, surveys, personal web pages or profiles, forums, bulletin boards and other interactive features (collectively, “Interactive Services”) that allow users to post, submit, publish, display or transmit to other users or other persons (hereinafter, “post”) content or materials, including photos and videos, (collectively, “User Contributions”) on or through the Website. All User Contributions must comply with these Terms of Use, including without limitation, the Content Standards set out in Section 9.

Any User Contribution you post to the site will be considered non-confidential and non-proprietary. By providing any User Contributions, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors and assigns the worldwide, unrestricted, royalty-free, irrevocable, sub-licensable right to (a) publish, publicly display and perform, modify, edit, alter and otherwise use the User Contributions in whole or in part, without further consent, review or participation from you, for any purpose throughout the world (including commercial and promotional) in any medium or format now existing or hereafter created, including but not limited to print or recorded material, websites, and social media platforms; and (b) use your name, commentary, and other information about you in connection with the User Contributions. You represent and warrant that (x) you own or control all rights in and to the User Contributions and have the right to grant the license granted above; and (y) all of your User Contributions do and will comply with these Terms of Use. We reserve the right to use, not use, or discontinue using any User Contributions in our sole discretion at any time.

Additional Terms for Submitted Photos and Videos

The Website may allow you to submit photos and videos (collectively “photos”) to NOBULL. If you do, such photos will be considered “User Contributions” and all applicable terms and conditions in these Terms of Use shall apply. Please do not provide any photos that you did not take yourself or that you do not have permission to provide to us. By sending us photos, you represent and warrant to NOBULL that you have taken the photos yourself, you own all copyright, intellectual property rights and other rights to the photos, or that you have received the express written permission from the all relevant rights holder(s).

If other persons appear in the photos, you represent and warrant that you have received express permission from all such persons to take their photo and to provide it to NOBULL in accordance with these Terms of Use (which you have provided a copy of to all such persons). DO NOT PROVIDE ANY PHOTOS THAT CONTAIN THE IMAGE OF ANY MINORS UNDER 18 YEARS OLD.

MONITORING AND ENFORCEMENT; TERMINATION

We reserve the right (but not the obligation) to:

Remove or refuse to post any User Contributions for any reason or no reason at all, at our sole discretion.
Take action against any User Contribution that we determine, at our sole discretion, to be in violation of these Terms of Use, including the Content Standards, or that:
- Infringes on any intellectual property or other rights of any individual or entity.
- Threatens the safety of users of the Website/iOS Application or the general public.
- Could expose GIJoeCodes, LLC to legal liability.
Pursue appropriate legal action, including, but not limited to, reporting violations to law enforcement in response to any illegal or unauthorized use of the Website/iOS Application.

We do not commit to reviewing all material before it is published on the Website/iOS Application and cannot guarantee the immediate removal of objectionable content once posted. Consequently, we assume no liability for any action or inaction regarding User Contributions or other content shared by users or third parties. This includes, but is not limited to, content that presents itself as advice—such as medical, diet, training, fitness, or exercise-related guidance, or recommendations on the use of any products or services.

We bear no liability or responsibility for the execution or non-execution of any actions described in this section.

CONTENT STANDARDS

These content standards apply to all User Contributions and the use of Interactive Services within the Website/iOS Application. All User Contributions must fully comply with all applicable federal, state, local, and international laws and regulations.

Without limiting the foregoing, User Contributions must not:

Contain any material that is defamatory, obscene, indecent, abusive, sexually explicit, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.

Promote, advocate, or assist in any illegal activity or unlawful act.
Contain medical advice or suggest that it provides medical expertise.
Cause annoyance, inconvenience, undue anxiety, or distress, or be intended to embarrass, alarm, or harass any individual.
Impersonate any person or misrepresent your identity or affiliation with any person or organization.
Promote any third-party organizations or businesses without prior approval.
Involve commercial activities or sales, including contests, sweepstakes, sales promotions, bartering, or advertising.
Suggest or imply that content originates from, or is endorsed by, GIJoeCodes, LLC, unless this is explicitly authorized.

NO RELIANCE ON INFORMATION POSTED

The information presented on or through the Website/iOS Application is provided solely for general informational purposes. We do not warrant the accuracy, completeness, timeliness, or usefulness of any information.

All features, content, specifications, products, and pricing of goods and services displayed on the Website/iOS Application are subject to change at any time without notice.

ARBITRATION; JURY TRIAL WAIVER; CLASS ACTION WAIVER

You and GIJoeCodes, LLC agree to resolve all disputes through individual (non-class) arbitration.

Neither you nor GIJoeCodes, LLC may file a lawsuit in court in connection with any dispute or Claim related to or arising from the Website/iOS Application. All Claims must be resolved exclusively through arbitration.

By continuing to use the Website/iOS Application, you indicate your acceptance of these Terms of Use, including this agreement to arbitrate.

You and GIJoeCodes, LLC acknowledge that this agreement to arbitrate is enforceable under the Federal Arbitration Act (FAA), 9 U.S.C.A. §§ 1–16.

You and GIJoeCodes, LLC expressly waive the right to pursue court action or administrative proceedings to resolve any Claims. Additionally, both parties waive the right to a jury trial for all Claims.

Arbitration Process

All arbitration proceedings shall be conducted exclusively in Massachusetts before one arbitrator.
Arbitration shall be administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures, available at http://www.jamsadr.com/rules-streamlined-arbitration/.
Judgment on the arbitration award may be entered in any court with appropriate jurisdiction.
If JAMS is unable or unwilling to administer arbitration, either party may petition a court of competent jurisdiction to appoint an arbitrator from a list of candidates proposed by both parties.
Nothing in this section prevents either party from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

Class Action Waiver

You agree not to file or participate in a class action lawsuit against GIJoeCodes, LLC. You further agree not to file or participate in class arbitration against GIJoeCodes, LLC.

WAIVER AND SEVERABILITY

Failure to enforce any right or provision in these Terms of Use does not constitute a waiver of that right or provision.
If any provision of these Terms of Use is found invalid or unenforceable by a court of competent jurisdiction, the court shall endeavor to give effect to the intentions of the parties as reflected in the provision.
The remaining provisions of these Terms of Use shall remain in full force and effect.

NO LIABILITY FOR TRANSLATION ERRORS OR MISINTERPRETATIONS

The content provided on the Website/iOS Application may be made available in multiple languages for the convenience of users. Translations of any text, including but not limited to product descriptions, policies, legal agreements, and informational content, may be facilitated through automated translation services, such as Google Translate, or other third-party translation tools.

GIJoeCodes, LLC makes no representations, warranties, or guarantees regarding the accuracy, reliability, completeness, or appropriateness of any translated content. Users acknowledge and agree that automated translations may contain errors, omissions, inconsistencies, or misinterpretations, including but not limited to misspellings, incorrect terminology, contextual errors, or unintended meanings.

GIJoeCodes, LLC shall not be held liable for any misunderstandings, misinterpretations, legal consequences, damages, or disputes arising from errors or inaccuracies in the translated text on the Website/iOS Application.Users relying on translated content do so at their own risk and are encouraged to consult the original English versionof any content for accuracy. In the event of a discrepancy between the translated version and the original English version, the English version shall prevail and govern.

By continuing to use the Website/iOS Application, users acknowledge and agree to waive any claims against GIJoeCodes, LLC related to translation errors, misinterpretations, or typographical mistakes resulting from the use of automated or third-party translation services.

ENTIRE AGREEMENT; ADDITIONAL TERMS

These Terms of Use, together with our Privacy Policy and any Additional Terms, constitute the sole and complete agreement between you and GIJoeCodes, LLC regarding the Website/iOS Application. This agreement supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding your use of the Website/iOS Application.

Additional or separate terms (“Additional Terms”) may apply to specific features of the Website/iOS Application, such as:

Testimonials
Sweepstakes or contest entries

If applicable, these Additional Terms will be provided at the time you access such features and will be incorporated into these Terms of Use by reference.

In the event of a conflict between these Terms of Use and any Additional Terms, the Additional Terms shall governthe subject matter to which they apply.
